Ben Tymann's practice focuses on leading clients through disputes and litigation arising from business relationships and commercial transactions, land use and permitting challenges, and contested matters involving real estate, project development, and construction.
Ben also maintains a robust corporate compliance and internal investigations practice, specializing in advice to companies who do business with the government or face challenging regulatory environments on their most sensitive compliance risks. He has represented private as well as public sector clients in both litigation and compliance matters in multiple U.S. and foreign jurisdictions, and across industries, including construction and development, housing, construction materials, aeronautics, manufacturing, retail, biotech, and health care. His reputation for skillful handling of difficult and high-stakes matters led to his appoinment by the Massachusetts Superior Court as a Special Master in an ongoing complex commercial litigation action.

As part of his land use and zoning practice, Ben has a long track record representing Massachusetts housing developers, state subsidizing agencies, and interested parties at all levels of contested proceedings arising under Chapters 40A and 40B and the Boston Zoning Enabling Act. For nearly two decades he has been the primary author of the Low- and Moderate-Income Housing chapter of the MCLE’s Massachusetts Zoning Manual. He is also a leading practitioner in cases involving the Massachusetts Dover Amendment. Ben has served as Special Municipal Counsel for the Nantucket Conservation Commission, winning a recent case in Superior Court that upheld an aggressively-contested coastal protection decision of that regulatory body. He successfully handles high-stakes real estate and land use disputes for clients outside of Massachusetts as well, from Colorado to North Dakota’s Bakken oil fields.
In his compliance practice, Ben designs and implements comprehensive compliance programs for companies subject to the Foreign Corrupt Practices Act (FCPA), the False Claims Act (FCA), Disadvantaged Business Enterprise (DBE) regulations, and other aggressively enforced federal laws targeting fraud, bribery or corruption. His work in this area has included leading a global retail company’s anti-corruption compliance initiative in Sub-Saharan Africa. In addition to putting in place effective compliance programs aimed at reducing regulatory risks, Ben has acted as outside compliance counsel for numerous clients.
Before co-founding Tymann, Davis & Duffy in 2019, Ben operated his own successful law firm, Tymann LLC - Law & Compliance, for five years. Prior to that, Ben practiced for a dozen years at Mintz Levin, one of Boston's largest and most prestigious law firms, where he was a Member (Partner) in the Litigation and Land Use groups and chaired the firm's Corporate Compliance and Investigations Practice. Ben was also a Shareholder in the Litigation and Anti-Corruption Compliance groups at the global law firm Greenberg Traurig, practicing out of the firm's Boston and Washington, D.C. offices.
Prior to becoming a lawyer, he served as an active duty officer in the U.S. Army. While attending law school at night, Ben worked at the Massachusetts Department of Labor and Workforce Development, where he managed the state’s prevailing wage and occupational safety programs. He has a long record of community service and pro bono commitment, including previously serving as a board member and Past President of the Lawyers Clearinghouse, an organization providing legal services to the homeless, affordable housing groups, and community development organizations in the Boston area. Ben is an elected member of his hometown Select Board.
